EVENT POLICIES, TERMS, AND CONDITIONS

TERMS AND CONDITIONS OF ATTENDANCE AND PARTICIPATION

These are the terms (the “Agreement”) that govern attendance at and/or participation in any National Indian Child Care Association (collectively referred to herein as “NICCA”) events (the “Event”).

By registering for the Event, you are agreeing to these terms which form a legal contract between NICCA and the registered attendee and/or participant (“you”). If you are registering on behalf of another, it is your responsibility to ensure that the person attending is aware of these terms and accepts them, and by completing the registration you are warranting that you have made the attendee aware of these terms and that they have accepted these terms.

1. Event admission

1.1. Admittance. Your registration entitles you to admittance to the Event. Any and all other costs associated with your attendance (including without limitation any travel and/or accommodation expenses) shall be borne solely by you and NICCA shall have not liability for such costs.

1.2. Termination. You acknowledge that NICCA Events reserves the right to request your removal from the Event if NICCA Events, in its sole discretion, considers your presence and/or behavior to create a disruption or to hinder the Event and/or the enjoyment of the Event by other attendees or speakers.

1.3. Media. By attending the Event you acknowledge and agree to grant NICCA Events the right at the Event to record, film, photograph or capture your likeness in any media now available and hereafter developed and to distribute, broadcast, use or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to NICCA Events includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use and/or disseminate the media.

1.4. Event Content. You acknowledge and agree that NICCA Events, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, venue and time.

2. Exhibitors and vendors

2.1. Agreement. By registering for the event, the exhibitor/vendor submits to a contractual agreement between NICCA and the Exhibitor for the use of the space assigned.  The NICCA Event retains the right to assign and/or change exhibit locations due to unavoidable problems of the parties involved.  The NICCA Event reserves the right to refuse space to applicants whose exhibit materials are deemed to be not within the best interests of the Event.

2.2 Allowances. The Exhibitor will be provided with one (1) exhibit table including an 8-ft skirted table and two chairs. Electricity, internet, and other needs must be coordinated through the Event location directly. Meals are not included in the exhibit fee; however, meal tickets may be available onsite.

 

3. Fee(s)

3.1. Payment. The payment of the applicable fee(s) for the Event is due upon registration. If such payment is insufficient or declined for any reason NICCA Events may refuse to admit you to the Event and shall have no liability in that regard.

3.2. Taxes. The fee(s) may be subject sales tax, value added tax, or any other taxes and duties which, if applicable, will be charged to you in addition to the fee(s).

 

4. Substitution and cancellation policy

4.1 Substitution and Cancellation. After registering for the Event, if you cancel your attendance more than one (1) month prior to the date of the Event, you will receive an 50% refund of the amount of your payment. If you cancel within one (1) month of the date of the Event, you will not be eligible for a refund; however, substitutions (subject to availability) may be arranged at the sole discretion of NICCA Events.

 

5. Privacy policy

5.1. Privacy Policy. NICCA Events is part of the National Indian Child Care Association and is committed to protecting the privacy of its customers.

 

6. Intellectual property

6.1. Intellectual Property Rights. All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event are owned by NICCA Events and NICCA, and/or the Event sponsors or speakers presenting at the Event. You may not use or reproduce or allow anyone to use or reproduce any trademarks (including without limitation the conference theme, "NICCA", and "National Indian Child Care Association") or other trade names appearing at the Event, in any Event content and/or in any materials distributed at or in connection with the Event for any reason without the prior written permission of NICCA.

6.2. Rights of Use. For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by NICCA or any of its affiliates or grant to you any right or license to any other intellectual property rights of NICCA or its affiliates, all of which shall at all times remain the exclusive property of NICCA and its affiliates.

 

7. Warranties and limitation of liability

7.1. Warranties. NICCA Events gives no warranties in respect of any aspect of the Event or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness and merchantability. Neither NICCA Events nor its affiliates can accept any responsibility or liability for reliance by you or any person on any aspect of the Event and/or any information provided at the Event.

7.2. Liability. Other than to the extent required as a matter of law, neither NICCA Events nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement.

7.3. Limitations of Liability. The maximum aggregate liability of NICCA Events for any claim in any way connected with therewith or this Agreement whether in contract, tort or otherwise (including any negligent act or omission) shall be limited to the amount paid by you to NICCA Events under this Agreement to attend the Event.

 

8. Governing law and jurisdiction

8.1. Governing Laws. This Agreement shall be governed by the laws of the State of Oklahoma and the parties shall submit to the exclusive jurisdiction of the Oklahoma courts.

EVENT CANCELLATION AND REFUND POLICY

Cancellation and Refund Policy

After registering for a NICCA event, registrants are subject to the following cancellation and refund policy.

If you cancel before one (1) month of the first day of the event, you will receive a 50% refund of the amount of your registration. If you cancel within one (1) month of the first day of the event, you will not be eligible for a refund; however, substitutions (subject to availability) may be arranged at the sole discretion of NICCA. After the event starts, no refunds will be granted to registrants for any reason.

Please note: Non-advance payment of registration fees does not void the cancellation policy. The full balance of all registrations is still due in full, subject to the aforementioned cancellation policy, regardless of attendance.

All requests for event cancellations must be submitted in writing prior to the start of the Event. Please include the name of the registrant and the name of the event. Cancellation notifications must be emailed to events@nicca.us.  

Force Majeure Clause

In the event of cancellation due to natural and unavoidable catastrophes, NICCA will provide a credit for conference registrations which may be used within twelve (12) months for another NICCA event. Due to our inability to cancel special tracks and special events at late notice, we are unable to credit these items.

To receive a credit for the event registration, please send an email that includes the organization name and registered participant names within 14 days of the event close. Please include any back up documentation as you deem necessary. Credit requests must be emailed to events@nicca.us.

Substitutions

Substitutions are permitted; however, notification must be received in writing. Please send the name of the original registrant and the name of the person substituting at least two (2) weeks before the start of the event. Substitution requests must be emailed to events@nicca.us. Please include “Conference Substitution” in the subject line. Any substitutions made between two weeks and the event start date, will be assessed a $50 fee. Substitutions can also be made on-site at the conference registration desk with proof of payment for an original registrant and the $50 substitution fee.
